Terms of Service

These terms are an agreement between you and BlogKub ("we", "us", "our") for accessing and using the website www.blogkub.com and our Blogger theme builder. Please read them carefully. By accessing or using the service, you confirm that you have read, understood, and accepted these terms.

In short: BlogKub is a free tool that runs in your browser with no sign-up. The theme files you design and download are yours. The tool and the website themselves are our intellectual property, and the service is provided "as is".

1. Acceptance of these terms

By using our website or tool, you accept these terms and the related policies, such as our Privacy Policy. If you do not accept the terms, please do not use the service.

2. Description of the service

BlogKub is a tool for building and customizing themes (templates) for the Blogger platform that runs client-side in your browser. You can pick a template, customize elements by dragging and dropping, preview in real time, then export a Blogger XML file to upload to your own blog. The service is free to use and requires no account.

3. Eligibility

You must be legally able to enter into this agreement. If you use the service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

4. Acceptable use

You agree to use the service lawfully and appropriately, and not to do any of the following:

Use the service for any unlawful, deceptive, or rights-infringing purpose.
Attempt to hack, reverse engineer, disrupt, or damage the service or cause it to stop working.
Copy, reproduce, modify, or resell the tool or any part of the website without permission.
Use automated tools (bots or scrapers) in a way that places an unreasonable load on the system.
Create or publish content that is unlawful, harmful, or infringes the intellectual property of others through the work you make.

5. Intellectual property

The tool and the website: the software, source code, design, interface, logo, the name "BlogKub", and the content on the website (unless stated otherwise) are our intellectual property and are protected by law. You may not copy or use them commercially without written permission.

6. Rights in your work and exported files

Themes and content you create: the XML theme files you design and download, along with the text and images you add, are yours. You are free to use, modify, or publish them on your blog. You are responsible for ensuring that you have the right to use any images, text, or intellectual property you include in your work.

7. Relationship with Blogger and Google

BlogKub is an independent tool. It is not part of, not affiliated with, and not endorsed by Google or Blogger. The names "Blogger" and "Google" are trademarks of their respective owners. We reference them only to describe the tool's compatibility. Your use of Blogger is governed by Google's own terms and policies.

8. Third-party services and links

The website may contain links to external services such as Blogger, Google, or other resources. We are not responsible for the content, accuracy, or practices of those external sites. Your use of them is governed by the terms of the respective provider.

9. Service provided "as is" and no warranty

We provide the service "as is" and "as available". We do our best to make the tool work correctly and to make the resulting files uploadable to Blogger, but we do not warrant that the service will be error-free, uninterrupted, perfectly secure, or fit for every purpose. We strongly recommend that you back up your existing theme before uploading a new one, every time.

10. Limitation of liability

To the extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from the use of, or inability to use, the service, including loss of data, revenue, or effects on your blog. Your use of the tool and the resulting files is at your own risk.

11. Indemnification

You agree to defend and indemnify BlogKub against any claims, damages, or costs arising from your use of the service in breach of these terms or in violation of the rights of another person.

12. Changes and termination

We may improve, add to, limit, or discontinue some or all features of the service as appropriate, and we may revise these terms from time to time, noting the last updated date at the top. Continuing to use the service after a change means you accept the revised terms.

13. Governing law

These terms are governed by and interpreted under the laws of Thailand. Any dispute that arises falls under the jurisdiction of the Thai courts.

14. General

If any part of these terms is found void or unenforceable, the remaining parts stay in force. Our not exercising a right immediately does not waive that right. These terms are the entire agreement between you and us regarding your use of the service.
